" وَلَوْ مَعَهُمْ " أَيْ مَعَ الشُّهُودِ وَالْقَاضِي " فَعَلَيْهِ دُونَهُمْ " الْقَوَدُ أَوْ الدِّيَةُ لِأَنَّهُ الْمُبَاشِرُ وَهُمْ مَعَهُ كَالْمُمْسِكِ مَعَ الْقَاتِلِ وَقَوْلِي وَلَوْ مَعَهُمْ أَعَمُّ مِمَّا عَبَّرَ بِهِ
