مسألة: يجوز الخلع بقدر المهر، وبأقل وبأكثر، خلافا لأحمد وإسحاق في قولهما لا يجوز إلا بقدر المهر؛ لقوله تعالى: " فلا جناح عليهما فيما افتدت به " فعم، ولأنه عوض يصح تملكه فجاز الخلع عليه كالصداق.
