مسألة: يستحق بها الدم، خلافا لأحد قولي الشافعي؛ لقوله: «تحلفون خمسين يمينا وتستحقون دم صاحبكم» ، وروي: «يقسم خمسون منكم على رجل منهم يدفع إليكم برمته» ، ولأنها حجة ثبت بها كل عمد فجاز أن يستحق بها قتل من يثبت عليه، أصله الشهود.
