مسألة: إذا اشترك جماعة في قتل مؤمن فعلى كل واحد كفارة كاملة، وحكي عن الليث أن عليهم كفارة، وذكره بعض الشافعية؛ فدليلنا قوله تعالى: " ومن قتل مؤمنا خطأ فتحرير رقبة " فعم، ولأنه قاتل لو كان عمدا لزمه القود، فإذا كان مخطئا لزمته كفارة كاملة كالمنفرد.
