مسألة: لا يثبت اللواط إلا بأربعة شهود، وقال أبو حنيفة: يثبت بشاهدين، وبناه على أصله في أن الحد لا يجب فيه، فنقول: لأنه فرج يجب بالإيلاج فيه الغسل، فلم يثبت حكم العقوبة الواجبة بالإيلاج فيه بما دون الأربعة كفرج المرأة.
