مسألة: إذا قذف محصنا في الطاهر ففسق المقذوف، سقط الحد عن القاذف، وقال أبو حنيفة: لا يسقط؛ فدليلنا أن الحكم بالعفة من طريق الظاهر، والفسق أمر مستبطن، فإذا بان الفسق منه قدح ذلك في ظاهر عفته، فصار شبهة يسقط الحد عن قاذفه بذلك الزنا.
