مسألة: قال ابن المواز: إذا حلف لا يبيع سلعته فباعها وشرط الخيار لنفسه لا يحنث، وقال محمد بن الحسن: يحنث؛ فدليلنا أن الإيجاب لا يقع منه متنجزا فلم يقع البيع، لأنه يملك الرجوع فيه وإبطاله، واليمين على البيع إنما هي على الإيجاب الموضوع لإخراج الملك، وشرط الخيار يمنع إخراج الملك.
