مسألة: الحرز معتبر في القطع، خلافا لداود وغيره ممن لم يعتبره؛ لقوله صلى الله عليه وسلم: «لا قطع في تمر معلق ولا حريسة جبل إلا إذا آواه المراح والجرين، والقطع فيما بلغ ثمن المجن» ، وقوله: «ليس على المنتهب قطع ولا على المختلس» .
