مسألة: يجوز الرهن في السفر والحضر. خلافا لمجاهد في قوله: لا يجوز إلا في السفر؛ لأن كل وثيقة جازت في السفر جازت في الحضر كالضمان؛ ولأنها حال يجوز أن يتوثق فيها بالضمين فجاز بالرهن كالحضر.
