مسألة: إذا قسم الحاكم مال المفلس بين غرمائه، ثم طرأ غريم آخر رجع على الغرماء بما كان نصيبه بالحصاص له لو كان حاضرا، خلافا لمن قال لا يرجع؛ لأنه غريم لو كان حاضرا في وقت القسم لشارك الغرماء فإذا حضر بعد القسمة لم يسقط حقه، أصله إذا قسمت التركة بينهم ثم طرأ غريم آخر.
