جَمْعُ الْحَبْسِ تَعْزِيرًا مَعَ عُقُوبَاتٍ أُخْرَى: ١٤ - ذَهَبَ الْفُقَهَاءُ إِلَى جَوَازِ جَمْعِ الْحَبْسِ تَعْزِيرًا مَعَ غَيْرِهِ مِنْ عُقُوبَاتٍ. وَذَكَرُوا أَمْثِلَةً لِجَمْعِهِ مَعَ الْحَدِّ مِنْ مِثْل: جَلْدِ الزَّانِي الْبِكْرِ مِائَةً حَدًّا وَحَبْسِهِ سَنَةً تَعْزِيرًا لِلْمَصْلَحَةِ. وَعِنْدَ الْمَالِكِيَّةِ: حَبْسُهُ سَنَةً مَنْفِيًّا (٢) .
