١٦ - وَمِنْ أَمْثِلَةِ الْجَمْعِ بَيْنَ الْحَبْسِ وَالْكَفَّارَةِ: حَبْسُ الْقَاضِي مَنْ ظَاهَرَ زَوْجَتَهُ حَتَّى يُكَفِّرَ عَنْ ظِهَارِهِ دَفْعًا لِلضَّرَرِ عَنِ الزَّوْجَةِ. وَحَبْسُ الْمُمْتَنِعِ مِنْ أَدَاءِ الْكَفَّارَاتِ عَامَّةً حَتَّى يُؤَدِّيَهَا فِي أَحَدِ قَوْلَيِ الشَّافِعِيَّةِ (٢) .
