وَالْعشر فِيمَا يخرج مقدم على حق الْمُرْتَهن

قال: "والعشر فيما يخرج مقدم على حق المرتهن" لتعلقه بالعين ولا يبطل الرهن في الباقي؛ لأن وجوبه لا ينافي ملكه، بخلاف الاستحقاق.
