(وَعَنْهُ: مَا يَدُلُّ عَلَى أَنَّهَا لَا تَمْلِكُ الْفَسْخَ بِالْإِعْسَارِ) وَقَالَهُ عَطَاءٌ، وَالزُّهْرِيُّ ; لِأَنَّهُ إِعْسَارٌ عَنْ حَقِّ الزَّوْجَةِ، فَلَمْ تَمْلِكِ الْفَسْخَ كَمَا لَوْ أَعْسَرَ عَنْ دَيْنٍ لَهَا عَلَيْهِ، فَعَلَى هَذَا لَا تَمْلِكُ فِرَاقَهُ وَيَرْفَعُ يَدَهُ عَنْهَا لِتَكْتَسِبَ ; لِأَنَّهُ حَقٌّ لَهَا عَلَيْهِ
