وَكَونُهُ معلُومًا جِنسُهُ وَقَدْرُهُ وَصِفَتُهُ،

(وَ) الْخَامِسُ (كَوْنُهُ) ؛ أَيْ: الرَّهْنِ (مَعْلُومًا جِنْسُهُ وَقَدْرُهُ وَصِفَتُهُ) ؛ لِأَنَّهُ عَقْدٌ عَلَى مَالٍ، فَاشْتُرِطَ الْعِلْمُ بِهِ؛ كَالْبَيْعِ.
