(وَالْجَدُّ) لَا وِلَايَةَ لَهُ؛ لِأَنَّهُ لَا يُدْلِي بِنَفْسِهِ وَإِنَّمَا يُدْلِي بِالْأَبِ؛ فَهُوَ كَالْأَخِ. (وَالْأُمُّ وَسَائِرِ الْعَصَبَاتِ لَا وِلَايَةَ لَهُمْ) ؛ لِأَنَّ الْمَالَ مَحَلُّ الْخِيَانَةِ وَمَنْ عَدَّ الْمَذْكُورِينَ أَوَّلًا قَاصِرٌ عَنْهُمْ غَيْرُ مَأْمُونٍ عَلَى الْمَالِ،
