(شَرْطُهُ) أَيْ سَيِّدِهِ عَلَيْهِ (نَوْعَ تِجَارَةٍ) كَأَنْ يَشْتَرِطَ عَلَيْهِ أَنْ لَا يَتَّجِرُ إلَّا فِي نَوْعِ كَذَا لِمُنَافَاتِهِ مُقْتَضَى الْعَقْدِ، كَشَرْطِهِ عَلَيْهِ أَنْ لَا يَتَّجِرَ

(لا شرط نوع تجارة) . يعني: انه لا يصح أن يشرط على المكاتب أن لايتجر مطلقا، أو أن لا يتجر إلا في نوع كذا؛ لأن ذلك ينافي مقتضى عقد الكتابة الموضوع لتحصيل العتق.
