(وَالْحُرِّ وَالْمُدَبَّرِ وَالْمُكَاتَبِ وَأُمِّ الْوَلَدِ) ؛ لِأَنَّ مُوجِبَ الرَّهْنِ ثُبُوتُ يَدِ الِاسْتِيفَاءِ وَالِاسْتِيفَاءُ مِنْ هَؤُلَاءِ مُتَعَذِّرٌ لِاسْتِحْقَاقِهِمْ الْحُرِّيَّةَ فَصَارُوا كَالْحُرِّ قَالَ - رَحِمَهُ اللَّهُ -
