(فلا يصح) الرهن (من سفيه ومُفلِس) لأنه لا يصح بيعهما (و) لا من (مكاتَبٍ وعبدٍ، ولو مأذونًا لهم في تجارة) لأنه لا يصح تبرُّعهم (ونحوهم) كالمميز.

ولولي اليتيم ونحوه رهن ماله لمصلحة، ويكون بيد عدل.
