(فإن قبضه) أي: الرهن مرتَهِنٌ أو نائبه (بغير إذن) الراهن (لم يثبت حكمه) وهو اللزوم (وكان بمنزلة ما لم يقبض) لفساد القبض؛ لعدم إذن الراهن فيه.
