(وإن وجد) وارث (خطَّه) أي: خط مورثه (بدين له على فلان، جاز للوارث الحلف) إذا أقام به شاهدًا مثلًا، وكان يعلم أن مورِّثه لا يكتب إلا حقًّا، وأنه صادق أمين (ودُفع) الدين (إليه) فيجوز الحلف على ما لا تجوز الشهادة به، إذ لا يشهد على شهادة أبيه أو غيرها، إذا رآها بخطه.
