(ولو شرط مُعتقها عليها دوام النكاح تحت حُرٍّ) إن قلنا: لها الفسخ إذا عتقت تحته (أو) شرط عليها معتقها دوام النكاح تحت (عبد، إذا أعتقها، فرضيت) بالشرط (لزمها ذلك) وليس لها الفسخ إذًا، كأنه استثنى منفعة بُضعها للزوج، والعتقُ بشرطٍ جائزٌ.
