(وكذا لو كان) الصيد (فيه حياةٌ مُستقرَّة فوق حركة المذبوح، ولكن لم يتسع الوقت لتذكيته) فيحل بالشروط الأربعة؛ لأنه بعدم الاتساع لتذكيته غيرُ مقدور على تذكيته، فأشبه ما لو وجده ميتًا.
