(وإن لم يكن له) أي: القاضي (فيه) أي: في البلد الذي به الغائب (خليفةٌ، وكان فيه من يصلُحُ للقضاء، أَذِنَ له في الحكم بينهما) فيكون نائبًا عنه في تلك القضية.
