(وَلَوْ أَخَذَهُ) أَيْ الصَّيْدَ الضَّعِيفَ مُحْرِمٌ (لِيُدَاوِيَهُ فَوَدِيعَةٌ) لَا يَضْمَنُهُ بِلَا تَعَدٍّ وَلَا تَفْرِيطٍ لِمَا تَقَدَّمَ

معونة أولي النهىIbn al-Najjar

(ولو أخذه) أي: أخذ المحرم الصيد الضعيف (ليداويه: فوديعة) أي: فحكمه حكم الوديعة. فمتى مات بيده من غير تقصير في حفظه ولا تعد عليه لم يضمنه.
