(وَلَا يَبِيعُهُمْ) أَيْ لَا يَصِحُّ أَنْ يَبِيعَ الْمُكَاتَبُ ذَوِي رَحِمِهِ الْمَحْرَمِ لِأَنَّهُ لَا يَمْلِكُهُ لَوْ كَانَ حُرًّا فَلَا يَمْلِكُهُ مُكَاتَبًا

(ولا يبيعهم) أي: ليس له بيعهم، لأن من يعتق على من صار إليه ينزل منزلة جزئه. فلم يملك بيعه " كبعضه.
