(وَلَا حَدَّ بِقَذْفِ أُمِّ وَلَدٍ) لِأَنَّهَا أَمَةٌ تَعْتِقُ بِالْمَوْتِ أَشْبَهَتْ الْمُدَبَّرَةَ.

معونة أولي النهىIbn al-Najjar

(ولا حد بقذف أم ولد) على الأصح؛ لأنها أمة حكمها حكم غيرها من الإماء في أكثر الأحكام. ففي الحد أولى؛ لأنه يدرأ بالشبهات ويحتاط لإسقاطه.

ولأنها أمة تعتق بالموت. أشبهت المدبرة.
