(ثم إن كان) المرهون بعضه (مما لا يُنقل) كالعقار (خَلَّى) الراهن (بينه) أي: الرهن (وبينه، وإن لم يحضر الشريكُ) ولم يأذن؛ إذ ليس في التخلية بينه وبينه تعدٍّ على حصة الشريك.
