(فإن سَمَحَ الراهن ببيع الجميع) من الثمرة المرهونة وما اختلطت به (على أنه رهن) جاز؛ لأنه كزيادة الرهن. (أو اتفقا) أي: الراهن والمرتهن (على) بيع (قَدْرٍ منه جاز) لأن الحق لا يعدوهما.
