(وإن اختلفا، أو تشاحَّا، فـ) يقدم (قول الراهن مع يمينه) لأنه مُنكِرٌ. (وان رهن المُكاتَب من يعتق عليه) من ذوي رحمه المحرم، كأبيه وأخيه وعمه (لم يصح) رهنه (لأنه لا يملك بيعه) لما يأتي في الكتابة.
