(فإن كان) الرهن (مشروطًا في البيع، ثبت له) أي: للمُرتَهِن (الخيار فيه) أي: في البيع؛ لأن المشتري لم يوفِ له بشرطه (وإلا) يكن الرهن مشروطًا في البيع (سقط حَقُّه) من الاستيثاق، ولم يملك المطالبة ببدله؛ لأن الرهن غير واجب، وكذا حكم قرض.
