(وإن كان الراهن مفلسًا حيًّا أو ميتًا) وباع العدل الرهن، وتلف ثمنه بيده، ثم ظهر مستحقًا (كان المُرتَهِن والمشتري أسوةَ الغرماء) لأنهم تساووا في ثبوت حقهم في الذِّمة.
