(فإن لم يستغرق الأَرْشُ قيمته) أي: قيمة العبد (بيع منه) أي: من العبد (بقَدْرِه) أي: الأرش؛ لأن بيعه إنما جاز ضرورة، فيتقيد بقَدْرِ الحق (وباقيه) أي: العبد (رهن) لزوال المعارض
