(وإن جُني عليه) أي: المرهون (جناية موجبة للقصاص، أو غيره) أي: أو مال (فالخصم سيده) لأنه المالك له، والأَرْش الواجب بالجناية ملكه، وإنما للمُرتَهِن فيه حق الوثيقة
