(فإن أخَّر) السيدُ (المطالبة لغيبة، أو عُذْر) من نحو مرض (أو غيره، فللمُرتَهِن المطالبة) لأن حقه متعلِّق بموجَبها، كما لو كان الجاني سيده (ويأتي آخر الوديعة بعض ذلك. ولسيده) أي: سيد المرهون المجني عليه عمدًا
