(ولا يصح) الضمان (من سفيه) لعدم صحة تصرُّفه (ولا) يصح الضمان (من عبدٍ بغير إذن سيده، ولو كان مأذونًا له في التجارة) لأنه عقدٌ تضمَّن إيجابَ مالٍ، فلم يصح بغير إذن السيد كالنكاح.
