(وإن جعلاه) أي: جعل المتقارضان الربح (بينهما وبين عبد أحدهما أثلاثًا، فلصاحب العبد الثلثان) أي: الثلث المشروط له والثلث المشروط لعبده (وللآخر الثلث) لأنه الذي شرط له.
