(وإن ادَّعى كلٌّ منهما) أي: الشريكين (السَّبْقَ، فتحالفا، أو) أقاما بينتين، و (تعارضت بينتاهما، فلا شُفعة لهما) أي: لأحدهما على الآخر؛ لأنه لم يثبت السبق لواحد منهما.
