(وإن وضعها) الوديع (في حِرْزِ مِثْلها، ثم نَقَلَها) الوديع (عنه إلى حِرْزِ مِثْلها، ولو كان) المنقول إليه (دون) الحِرْزِ (الأول، لم يضمن) الوديع الوديعة؛ لأن صاحبها رَدَّ حفظها إلى اجتهاده، ولم يحصُل منه تفريط.
