(وكذا لو أمره بالردِّ) أي: رد الوديعة (إلى وكيله، فتمكَّن) المستودَع من ردها للوكيل (وأبى) ردها (ضَمِن) المستودَع الوديعة إن تلفت، سواء (طلبها الوكيل، أم لا) لأنه أمسك مال غيره بغير إذنه.
