(ويرث أخوه) أي: المنفي بلِعان، وولد زنىً ونحوه (لأمّه مع بنته بالعصوبة فقط) فإذا مات عن بنت وأخ لأم, فلبنته النصف، والباقي لأخيه لأمِّه عصوبة، ولا شيء له بالفرض؛ لسقوطه بالبنت.

و (لا) ترث (أخته لأُمّه) مع بنته شيئًا؛ لأنها محجوبة بالبنت عن الفرض ولا عصوبة لها.
