(وإن كان الأول غير مُوَحٍّ و) الجرح (الثاني مُوَحٍّ، فالحكم للثاني في الحظر) إن كان الثاني مجوسيًّا أو نحوه (والإباحة) إن كان مسلمًا أو كتابيًّا مسميًا؛ لأن الإباحة حصلت به.
