(وإن أسقط) الشفيعُ (شُفعته قبل الحكم بشهادته) بعفوِ شريكه، أو بببيع الشِّقص (قُبلت) شهادته؛ لانتفاء التُّهمة، و (لا) تُقبل شهادته إن عَفَا عن شُفعته (بعد الردِّ) لشهادته؛ لأنه مُتَّهم، لكونه إنما عَفَا لتُقبل شهادته.
