(فلو فُسخ العقدُ) بنحو عيب (رجع) المشتري (بقيمة المبيع عند تعذُّر معرفة الثمن) بتلف الصُّبْرة، أو الصَّنْجة، أو الكيل المجهولين، وعدم ضبط نفقة العبد. وقلنا: يرجع بقيمة المبيع إذن؛ لأن الغالب أنَّ الشيء يُباع بقيمته.
