(لا وَطْء الأمَة) المبيعة (ودواعيه) أي: دواعي الوَطء، من قُبْلة ونحوها؛ فلا يصح استثناؤه؛ لأن ذلك لا يُباح إلا بملك، أو نكاح وقد انتفيا.
