(وإن تصرَّف البائع) في المبيع (لم ينفذ تصرُّفُه، ولو) كان (عِتقًا) لانتقال الملك عنه للمشتري (سواء كان الخيار له) أي: للبائع (وحدَه، أو لا) بأن كان للمشتري وحده أوْ لهما
