فَإِنْ اخْتَارَهَا عَقِبَ عَفْوِهِ مُطْلَقًا أَوْ عَفَا عَلَيْهَا بَعْدَ عَفْوِهِ عَنْهَا وَجَبَتْ

" فَإِنْ اخْتَارَهَا " أَيْ الدِّيَةَ " عَقِبَ عَفْوِهِ مُطْلَقًا أَوْ عَفَا عَلَيْهَا بَعْدَ عَفْوِهِ عَنْهَا وَجَبَتْ " فَاخْتِيَارُهَا فِي الْأُولَى وَهُوَ مِنْ زِيَادَتِي كَالْعَفْوِ عَلَيْهَا

وَلَمَّا كَانَ الْعَفْوُ عَنْهَا لَغْوًا فِي الثَّانِيَةِ صَحَّ الْعَفْوُ عَلَيْهَا وَإِنْ تَرَاخَى عَنْهُ
