مسألة: وللزوج أن يلاعن وإن قدر على إقامة البينة، خلافا لقوم؛ لأن اللعان يستفاد به ما لا يستفاد بالبينة من نفي الولد وزوال الفراش، والحاجة، داعية إليه مع وجود البينة، كما تدعو إليه مع عدمها فجاز في الحالين.
