مسألة: وتقتل الجماعة بالواحد، خلافا لداود؛ لقوله صلى الله عليه وسلم: «العمد قود كله» ، وقوله: «من قتل له قتيل فأهله بين خيرتين إن شاءوا قتلوا» فعم، ولأنه إجماع الصحابة لأنه روي عن عمر وعلي وابن عباس، ولا مخالف لهم، ولأن كل حد وجب للإنسان على غيره إذا انفرد به وجب عليه وإن شارك فيه كحد القذف.
