مسألة: إذا زوج ابنته من مكاتبه، ثم مات وكانت ابنته وارثة له فان النكاح ينفسخ، وقال أبو حنيفة: لا ينفسخ؛ ودليلنا أن حكم الملك إذا منع ابتداء النكاح منع استدامته كالعبد القن، وقد ثبت أنها لو أرادت أن تتزوجه ابتداء في هذه الحال لم يصح العقد عليه، كذلك إذا طرأ حكم الملك على نكاحها.
